OLD LYME ZONING COMMISSION
REGULAR MEETING
Monday – April 13, 2015, 7:30 P.M.
Meeting Hall at Memorial Town Hall

1.  Convene Meeting; announcement of voting members.  Members present:  J. Cable, J. Marsh, J. Bozek, S. Winchell  

Present:  Keith Rosenfeld, Land Use Coordinator

Absent:  J. Johnson and G. Soucie  

PUBLIC HEARING:

1.  Special Permit Application to permit a vertical expansion of the existing structure by adding two shed dormers and expanding the existing second floor bedrooms to the northwest above the existing first floor foot print with no additional bedrooms being added to the second floor on property located at 24 West End Drive in accordance with Section 9.1.3.1 of the Old Lyme Zoning Regulations, Samuel H. Havens, owner/applicant.

A Motion was made by J. Bozek, seconded by S. Winchell to CONTINUE to May 11, 2015 at 7:30 p.m. in the Meeting Hall the Public Hearing on the Special Permit Application to permit a vertical expansion of the existing structure by adding two shed dormers and expanding the existing second floor bedrooms to the northwest above the existing first floor foot print with no additional bedrooms being added to the second floor on property located at 24 West End Drive.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J.Bozek,  S. Winchell  Opposed:  None   Abstaining:  None   The motion passed unanimously. 4-0-0

REGULAR MEETING:

Havens, owner/applicant – Continued to May 11, 2015.  

2.  Municipal Coastal Site Plan Review Application for demolition and construction of a new single family dwelling on property located at 10 Joffre Road West.

A Motion was made by J. Marsh, seconded by J. Bozek to receive the Municipal Coastal Site Plan Review Application on property located at 10 Joffre Road West and send it to the DEEP for review.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J. Bozek, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 4-0-0

3.  Special Permit Application for a grocery beer permit on property located at 389 Shore Road, South Lyme Station, LLC, applicant.  

A Motion was made by J. Marsh, seconded by J. Bozek to receive the Special Permit Application for a grocery beer permit on property located at 389 Shore Road, South Lyme Station, LLC and set a Public Hearing for Monday, May 11, 2015 at 7:30 p.m. in the Meeting Hall.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J. Bozek, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 4-0-0

A Motion was made by J. Marsh, seconded by J. Bozek to add new business discussion for Section 9.03 (Casualty-Building or Structures/Non-conforming Lots, Uses, Buildings, and/or Structures) of the Regulations as it pertains to The Boxwoods located at 7-1a to 7-1d Lyme Street.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J. Bozek, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 4-0-0

4.  New Business   –  A Motion was made by J. Marsh, seconded by S. Winchell to GRANT an extension to November 9, 2016 in accordance with Section 9.03 of the Zoning Regulations in order to complete their restoration.  Discussion:  J. Bozek asked about the finding of abandonment and a public hearing as stated in the regulations as written.  S. Winchell asked about the two year period as stated in the regulations.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J. Bozek, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 4-0-0

5.  Old Business         –  Discussion with respect to the definition of “school” as an amendment to
                                         the Zoning Regulations

A Motion was made by J. Marsh, seconded by J. Bozek to refer the following definition of a “school” to Attorney Branse for review.  School:  Any structure, the use of which meets State licensing requirements for accredited primary, secondary or college instruction and education.  Such school may be public or private and is a permitted structure and use in all zoning districts.”  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, J. Bozek, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 4-0-0

A Motion was made by J. Marsh, seconded by J. Bozek to adjourn the April 13, 2015 Regular Meeting.    The meeting adjourned at 9:15 p.m.
